ASML Files Counterclaim Against Nikon Over Ten Patent Infringement
ASML and partner Zeiss are suing Nikon for infringing ten of its patents. Nikon would use the technology described in the patents for its chip machines and digital cameras. It concerns a counter-charge by ASML and Zeiss.
Nikon would use the technology of the ten patents in a wide range of products, according to ASML. In addition to chip machines and digital cameras, the company also mentions production machines for flat screens. ASML’s CEO says he has been forced to file counterclaims: “We have spent many years trying to reach a license agreement that reflects the increased strength of our patent portfolio. Unfortunately, Nikon never seriously participated in negotiations.”
ASML hopes to be able to use enough relevant patents to pose a threat to Nikon and possibly to negotiate a settlement, as often happens in patent cases. Earlier this week, Nikon announced that it would sue ASML for patent infringement. The case can be traced back to the beginning of this century, when the two companies reached an extensive settlement in which patents were mutually licensed. Some agreements expired on December 31, 2009, but negotiations on renewal came to nothing.
