Apple appeals patent lawsuit with Samsung

Apple will appeal in the patent case against Samsung to enforce a sales ban. As a result, the legal tug-of-war between the two companies continues, despite the fact that both companies previously announced that they would discontinue most lawsuits.

Apple plans to appeal a ruling by a US judge that ruled there was no justification for a sales ban on Samsung smartphones. According to judge Lucy Koh, Apple has not sufficiently proven that it has suffered “significantly” from sales of Samsung smartphones that infringe Apple patents, The New York Times reported. Also, Apple has not shown that the alleged damage was caused by patent infringement by Samsung.

In the umpteenth lawsuit between Apple and Samsung, it was previously ruled that the latter must pay damages for patent infringement. That amount came to approximately 86 million euros. However, the amount was significantly lower than the approximately 1.6 billion euros in damages that Apple had requested, which has already led to an appeal. Incidentally, Samsung also appealed against the compensation imposed.

Apple and Samsung have been fighting a legal battle for years. Despite a number of imposed damages, the lawsuits have had little impact on Samsung’s business. Earlier this month, both companies announced that most lawsuits against each other will expire.
