Administrator takes torrent site Alles-gratis.biz offline at the behest of Brein
Stichting Brein has addressed the administrator of torrent site Alles-gratis.biz about copyright infringement, after he had already signed an abstention statement in 2011. The organization threatened with a high claim, but ultimately did not impose it.
According to Brein, the site, which is no longer accessible at the time of writing, was managed by a 37-year-old man. The site, which is said to have had about 10,000 members, allowed users to share movies, series and music, among other things. The foundation originally wanted to impose a claim of 61,500 euros on the manager, but arrived at an undisclosed lower amount.
This would have to do with the personal situation of the man. The fine amounted to a high amount because he had already signed a declaration of abstention in 2011, in which he stated that he would not commit any further infringements. If he did, there was a penalty of 500 euros per day. Brein says he has proof that the man had the torrent site under his management for at least 123 days, and thus arrives at the aforementioned amount.
Brein reports that if the administrator is once again guilty of copyright infringement, it wants to impose the full penalty. In addition, the organization then wants to file a report. In a previous case, Brein already filed a complaint because an online seller of media players continued offline after he was approached by the foundation. The police then seized the media players. These were standard equipped with add-ons with which copyrighted material could be viewed.
