Uniloc challenges millions in fine in Microsoft patent case

The Singaporean company Uniloc will appeal against a judge’s ruling, which ruled that Microsoft should not pay damages of 388 million dollars after all for infringing a patent of Uniloc.

According to Uniloc, the activation of Windows XP infringed a patent that the company owns. Microsoft disagreed. After years of legal battle, a jury decided in April this year that there was indeed a patent infringement and that Microsoft had to pay $ 388 million in damages to Uniloc.

This week, the judge on the appeal, which Microsoft had filed, ruled that the jury had used wrong standards in determining damages. The judge also found that Microsoft did not infringe Uniloc’s patent. There will have to be a new process. Even if the jury there rules that Microsoft is guilty of patent infringement, the damages will be determined differently and will probably be much lower as a result.

Uniloc is dissatisfied with this new judgment and has now announced that it will appeal reports eWeek. “We are disappointed with the judge’s decision to overturn the jury’s unanimous verdict in Uniloc’s patent case against Microsoft,” Uniloc said in a statement.
